In another application of a negligent misrepresentation action against a design professional, a modern York court exonerated an architectural firm in a suit by way of a contractor that alleged defamation and negligent misrepresentation. The contractor claimed that statements made by the agency of the architect to the possessor resulted in the contractor's termination. on the contrary the court ruled that the architect's statements critical of the contractor's work were expressions of opinion, and thus were sheltered by a qualified privilege.
