Fourteen years ago, the Occupational Safety and Health Review Commission established criteria below which a design firm or construction manager is subdue to OSHA construction safety standards. Now OSHA has adopted just discovered standards which - if upheld may for the first time make liable design firms to OSHA penalties for violation of the safety regulations.
In 1977 the commission establish an architectural firm not liable because it was not identified as a construction manager, and conclud that "an employer must perform actual construction work or exercise substantial supervision
